This policy explains how Pacific Sport & Spine, LLC, doing business as Movement Fix (“we”), collects, uses and shares consumer health data, as Washington’s My Health My Data Act, Nevada’s consumer health data law and similar laws define it. Our Privacy Policy explains how we handle other personal information.
Consumer health data we collect and why
- The topic you choose: which free guide or email course you ask for (for example, Shoulder Basics). We use it to send you what you asked for and, only if you tick the box when you sign up, to send you offers on related programs.
- The programs and courses you buy, and your progress in them (lessons completed and quiz answers), including purchases you made before we moved our emails to this Site. We use them to give you access, keep your place and answer your questions.
- Anything you tell us about pain, an injury or your health in an email, a comment or a review. We use it to answer you and, for comments and reviews, to publish it where you posted it.
We don’t ask for your diagnosis or medical history. We use Google Analytics, with Google’s advertising features turned off, to count visits to our pages. It works for us under Google’s data processing terms. It sees the pages you view, but it never receives your name or email address, and when you sign up or buy, it gets only a code number for the guide or program, not its name. In Europe and Brazil it runs only if you agree, and everywhere else you can turn it off with “Your privacy choices”. We don’t track whether you open our emails or which links you click.
Where it comes from
From you, through our forms, checkout, courses, messages and comments. If you subscribed or bought before we moved our emails to this Site, also from the email services we used before (such as Kit and Brevo), whose records we moved here.
Who we share it with
- Processors that handle it only for us: SiteGround (website hosting), Cloudflare (website delivery and security), Amazon Web Services (Amazon SES) and Brevo (email delivery), Google Workspace (our email inbox) and Google Analytics (website statistics, which receive code numbers, not names).
- Where needed to provide what you asked for: Stripe and PayPal receive what you bought so they can process your payment, and they also use payment details under their own privacy policies, for example to prevent fraud. Vimeo plays the course videos you bought. Akismet, from Automattic, checks comments for spam before we publish them.
We also disclose consumer health data when the law requires it. We have no affiliates. We do not sell consumer health data, and we do not share it with advertising companies.
Your rights
You have the right to:
- confirm whether we collect, share or sell your consumer health data, and get a copy of it, including a list of every third party and affiliate we have shared or sold it to, with a way to contact each of them;
- withdraw your consent to our collecting or sharing it;
- have it deleted. We also tell our processors to delete it, and it is removed from our backups within six months.
To use these rights, email [email protected] with the subject “Health data request”. We confirm your identity by checking that you control the email address in our records and, for purchases, an order number. We answer within 45 days, or tell you within that time if we need up to 45 more days. Requests are free, up to twice a year.
Appeals
If we decline your request, you can appeal by replying to our answer or by emailing [email protected] with the subject “Health data appeal”. We will answer in writing within 45 days and explain our decision. If we deny your appeal, you can complain to the Washington State Attorney General or, in Nevada, to the Nevada Attorney General.
